General Data Protection Regulation
Since mid-2018, the General Data Protection Regulation (GDPR) has been in force. The same privacy legislation applies across the entire EU, which for the Netherlands meant a significant tightening of the rules. If your franchise organisation does not comply, or cannot sufficiently demonstrate that you are working on compliance, the potential consequences include high fines.
Specific expertise
It is important to have specific expertise on this regulation embedded within your organisation. Among other things, it is worth examining: which obligations does the GDPR impose on you as a franchisor and on your franchisees? Which elements may need to be included in or amended within the contract? Which processes and protocols must be documented? Will this create significant bureaucracy? Will it involve substantial costs? And can these costs be (partially) passed on to your franchisees?
